Before formal dispute resolution begins, we strongly encourage all parties to try to resolve the issue amongst themselves. We have opened up the messaging portal on Braintrust to allow direct communication between two parties. The vast majority of disputes can be resolved without having to use this formalized process. In fact, starting the formalized process can be a barrier to amicable resolution.
If a mutually agreed upon resolution cannot be reached, we invite you to enter into Braintrusts’ Dispute Resolution program.
If you have a dispute you’d like settled you can create a claim. Claims include:
- The resolution you’re seeking/desired outcome
- Identifying the person against whom the claim is made
- The grounds on which you’re staking your claim
- Supporting evidence and voluntary commentary
This claim will be reviewed by a community elected Jury Arbitrator for completeness and sent to the disputant. The disputant can choose to accept the claim, the desired outcome, and can settle the dispute.
Alternatively, they can also accept to file a counterclaim in response. Counter claims include:
- The resolution you’re seeking/desired outcome
- The grounds on which you’re staking your counterclaim
- Supporting evidence and voluntary commentary
After again reviewing the counterclaim for completeness, the Jury Arbitrator will present the counterclaim to the original claimant. The original claimant can accept the counterclaim, dropping their original claim, or they can escalate the dispute to Jury Members.
The Jury Arbitrator will review both the original claim and the counterclaim and identify subjective statements (example: “hired talent should have been able to complete this within 4 hours, based on their profile qualifications”) and will identify and seek judgement on each statement from no less than two members of the Jury Member pool.
Compiling both the claim, the counterclaim, and the eyewitness testimony, the Jury Arbitrator will again present the case to both the claimant and the disputant, both of whom can decide to drop their case, escalate to a jury, or accept the other member’s terms.
In the event that either party decides to escalate the case, both parties will be allowed to add a 500 word statement to accompany their claims to the Jury.
The Jury Arbitrator will randomly select three members of the jury - who were not also serving as eyewitnesses - and will issue an opinion on whether they side with the claimant or disputants claim. The Jury Arbitrator will inform all interested parties, and work with the Braintrust core team to implement the determination.
All decisions made through the Dispute Resolution process are final and cannot be appealed.
